How to Create a Master Trust
Here are the steps necessary to establish a trust if you think the Master Trust of California is right for you.
Estate Planning
If this trust will be funded from the estate of the developmentally disabled person's parent(s) or other family member, a Joinder Agreement should be completed and signed by the Trustor and sent to the Trust Committee for approval. The trust may be funded by gift or at death by inserting a pour over provision in your will or living trust.
Trusts Funded With the Assets of the Individual
If the trust is to be established with the assets of the individual who is developmentally disabled, then usually a Guardian or Conservator of the Estate will need to be appointed. In some cases the trust has been established through a litigation settlement or in estate probate proceedings without a guardianship or conservatorship.
If Court authorization is required, it is prudent that the Joinder Agreement first be submitted to the Trust Committee for approval. Subsequently you will need to send the Trust Committee a copy of the petition, and all attachments, and a copy of the Court Order, and all attachments, which authorizes the establishment of the trust. If a guardian or conservator is involved, you will also need to submit copies of the Court Order establishing the guardianship or conservatorship and the Letters of Guardianship or Conservatorship.
